In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent listed below.
Notice of Copyright Infringement
If you believe that content available on or through our website infringes one or more of your copyrights, please submit a written notice ("DMCA Takedown Notice") containing the information described below to our designated copyright agent. Upon receipt of a properly completed notice, we will take appropriate action, including removing the allegedly infringing content or disabling access to it.
Your DMCA Takedown Notice Must Include:
- Physical or electronic signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: A description of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate that material on our website (such as the specific URL).
- Contact information: Your address, telephone number, and email address so that we may contact you regarding your notice.
- Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Counter-Notification
If you believe that content you posted on The Excel Guide was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, a counter-notification must be a written communication that includes the following:
- Physical or electronic signature: Your physical or electronic signature.
- Identification of removed material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled (the URL of the content).
- Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original DMCA notice.
- Your contact information: Your name, address, and telephone number.
Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and inform them that we may restore the removed content within 10 to 14 business days unless the copyright owner files a court action against you.
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, The Excel Guide has adopted a policy of terminating, in appropriate circumstances, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Disclaimer on False Claims
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the website owner, or its service provider. If you are unsure whether the material you are reporting is infringing, please consult a legal advisor before filing a DMCA notice.
